Introduction

The last update of these Terms & Conditions dates from August 29th 2021.

These Terms & Conditions (the "Contract") govern the relationship between:

Any Internet user who bought the template Airtable Invoice Maker edited by Pierre-Louis Labonne (hereinafter referred to as "the User")

Firstly,

And

The freelancer Pierre-Louis Labonne, (hereinafter referred to as "the Seller")

On the other hand,

Each individually a “Party” and together the “Parties”.

The Seller offers paid access to a cloneable Airtable Base which is available at the following internet address https://airtableinvoicemaker.com ("the Template").

Article 1: Purpose of the Contract

The purpose of the Contract is to define the terms of access and use of the Template by the User.

Any User wishing to buy the Template must have previously consulted the Contract.

In addition, when purchasing, the User is invited to accept the Contract provided for this purpose.

If the User refuses to comply with any of the obligations and conditions contained in the Contract, he must renounce accessing and using the Template published by the Seller.

The User declares to be of legal age, or to be an emancipated minor, or, if this is not the case, to have obtained the consent of his parents or of his legal representatives to access and use the Template.

The Seller reserves the right to modify the Contract at any time.

Any modification will take effect immediately from the posting of the new version of the Contract on the Template.

The User therefore undertakes to regularly consult the Contract to take note of the modifications made to it.

Article 2 : Licence and Use

Purchasing the Template constitutes grants to the User of a non-exclusive, non-sublicensable, non-transferable license to copy on its own Airtable account and access that Template for the purpose of your own personal use.

Accordingly, the User agrees that he will not copy, reproduce, alter, modify, create derivative works except for his own personal, non-commercial use.

The User may not reproduce, repackage, or redistribute any of the content of the Template, in whole or in part, for any reason.

Article 3: Mean of payment

The Template purchase payment is processed and secured with Gumroad. A tax may be requested depending on the User's country. The User must be aware of these special conditions and any additional costs before confirming its purchase. This payment service are provided by the payment provider concerned under their sole responsibility.

According to Gumroad Terms of Service, the Users with a VAT ID have to enter it into their Invoice, which they can generate through their Gumroad receipt. The invoice they receive will reflect this refund, and the refund will hit their credit card accounts or PayPal accounts.

Article 4: Right of withdrawal / Refunds

In accordance with Article L. 221-28 of the French Consumer Code, the User acknowledges understanding that Airtable Invoice Maker template is digital content not provided on a physical medium, the execution of which began when purchasing the template, and that he expressly waives his right of withdrawal.

Article 5: Intellectual Property

The User agree that he will not copy, reproduce, alter, modify, create derivative works, or publicly display any content from the website Airtable Invoice Maker.

Article 6: Protection of Personal Data

All data entered in the Template belongs to the User and is not accessible by the Seller. To know the data use policy entered on the Template, the User should refer to Airtable Terms.

The Seller collects and uses the User's personal data in compliance with the provisions of French law n ° 78-17 of January 6th, 1978 known as “Informatique et Libertés”.

The purpose of the data collected is:

  • Sending information by email to Users;
  • Managing Seller's relationship with its Users (customer support).

The Seller does not transfer any personal data to third parties.

The Seller undertakes not to infringe on the User's privacy and to take all useful precautions to preserve the security and confidentiality of his personal data and in particular to prevent them from being modified, damaged or communicated to unauthorized persons, subject to the obligations that may fall to him within the meaning of French law n ° 2004-575 known as for Confidence in the Digital Economy.

The User has, with regard to all data collected or generated by his use of the Platform, a right of opposition, access, rectification and deletion.

Article 7: Responsibility of the Seller

PDF files generated by the Template are not a legal reference: the User of the template should check that documents generated comply with the legislation of their country (mandatory legal notices, etc.) The Seller can in no way be held responsible for the documents generated by the Template.

Article 8: Duration of the Contract

The Contract is concluded for the entire duration of use of the Template by the User.

Article 9: Applicable Law

The Contract is governed by French law.

In the event of a dispute between the Parties regarding the validity, performance or interpretation of the Contract, the Parties undertake to cooperate diligently and in good faith with a view to finding an amicable solution.

If no amicable agreement is reached within 2 (two) months from the notification to the other Party of such a dispute, exclusive jurisdiction is attributed to the competent courts within the jurisdiction of the Court of Appeal of Reims.
